UPDATED FMLA FORMS ISSUED; NO SUBSTANTIVE CHANGES
Earlier this month, the Department of Labor released updated Family and Medical Leave Act (FMLA) notices and certification forms. The updated notices and forms expire August 31, 2021. With the exception of the updated expiration date, no substantive changes were made to the forms. The updated forms can be downloaded from the Department of Labor’s website.
While there are not any substantive changes to the forms, employers should begin using the updated notices and forms immediately.
As we advised in May, pursuant to the Paperwork Reduction Act of 1995 the Department of Labor must submit its forms for review every three years to the Office of Management and Budget (OMB). The previous FMLA forms expired on May 31, 2018. When federal forms expire without OMB approving new proposed forms (as was the case here), the expiring forms renew on a month-to-month basis until new forms are approved.
